In fact, the Department of Labor is stepping up its efforts to audit employers to ensure they are properly classifying their employees for overtime purposes under the Fair Labor Standards Act and Colorado Minimum Wage Orders. These efforts by the DOL have recovered millions of dollars from employers in back wages in just the last few years alone. In addition, the DOL is cracking down on employers that mis-classify their people as “independent contractors” instead of employees. And the State of Colorado is increasing audits of companies across the state to uncover those who fail to properly verify the legal status their workers to work in the U.S.
